On July 1, 2023, the COVID-19 epidemic emergency is scheduled to be cancelled - that's the end of legal residence and the validity of residence cards for tens of thousands of foreigners in Poland!
If you were in Poland legally on March 14, 2020 or arrived in Poland after March 14, 2020, your stay under a temporary residence permit, visa or visa-free movement and the validity of your residence card has been extended by law due to the spread of the SARS-CoV-2 virus. This applies if the validity of your documents ended after March 14, 2020. The extension of legal residence and the validity of residence cards ends 30 days after the cancellation of the epidemic or epidemic emergency.
Legislation is currently underway to revoke the epidemic emergency as of July 1, 2023. This means that no later than one month after the revocation of the epidemic emergency takes effect, i.e. by July 30, 2023, you absolutely must:
- apply for a replacement residence card, or
- file an application for a residence permit, or
- apply for a visa extension, or
- leave Poland.
Failure to do so will render your documents obsolete and your stay and work illegal. It is very important to check whether your and your family's stay is still legal - especially if you have been leaving Poland at this time.
Remember, too, that the regulations extending the legality of your stay apply only on Polish territory and other EU countries do not recognize them!
If you are a citizen of Ukraine - you and your family are covered by the provisions of the special law on assistance to citizens of Ukraine in connection with the armed conflict on the territory of that country. This means that you are covered by special protection, independent of the lifting of the COVID-19 emergency. Your stay is legal in Poland until March 4, 2024, and in some cases even until August 31 or September 30, 2024. If you plan to stay in Poland and work - you can apply for temporary residence and work now.
