Very important changes in the legalisation of temporary residence in Poland for citizens of Ukraine!

The President of the Republic of Poland on 23 January 2023 signed an amendment to the Act on Assistance to Citizens of Ukraine, which was published in the Journal of Laws on 27 January 2023.

This law introduced important changes to the legalisation of residence of Ukrainian citizens fleeing the war to Poland.

Until 24 August 2023, legal residence in Poland is available to citizens of Ukraine who:

  1. Arrived in Poland after 24 February 2023 in connection with the armed conflict and received temporary protection;
  2. Have obtained a national or Schengen visa valid after 24 February 2022;
  3. Have a temporary residence permit valid on 24 February 2022;
  4. Were obliged to leave Poland or voluntarily return within the period from 24 February 2022.

From 1 April 2023, Ukrainian citizens with UKR status will be able to apply for a temporary residence and work or business permit. This is extremely beneficial for foreigners who tie their future to Poland because the period of temporary residence is included in the 5-year period of residence in Poland, which is required, among other things, to apply for a long-term EU resident's residence.

Ukrainian citizens who wish to stay in Poland until 24 August 2023 at the latest will have to apply for a temporary residence permit under the general rules. If their applications have certain formal deficiencies, they will be able to obtain a temporary residence permit for a period of 1 year.

As of 24 August 2023, the regulations extending the legal stay in Poland for all foreigners will be repealed, due to COVID-19.

Note that all foreigners must watch out if the epidemic emergency is lifted earlier than 24 August 2023. They will then have 30 days to apply for temporary residence in Poland, but no later than 24 August 2023.
